After a car crash, your own auto policy's Personal Injury Protection (PIP) benefits pay your medical bills and wage loss regardless of who was at fault, under MCL 500.3107. — Baldori Law 2. To bring a third-party injury claim against an at-fault Michigan driver for pain and suffering, your injury must meet the threshold in MCL 500.3135: death, serious impairment of body function, or permanent serious disfigurement. This claim is separate from your own PIP benefits. — Baldori Law 3. Under MCL 500.3142, Michigan PIP benefits are generally overdue 30 days after the insurer receives reasonable proof of the fact and amount of the loss, and overdue benefits carry 12% simple interest. — Baldori Law 4.
